    A tax-efficient way for 'resident non-doms' to bring money onshore

WHAT IS BUSINESS INVESTMENT RELIEF?

If you are UK-resident but not UK-domiciled (a ‘resident non-dom’), Business Investment Relief (BIR) allows you to remit your overseas income and gains into the UK without triggering an immediate tax liability. Without BIR, such a remittance would usually be taxable at 45%.

 

The relief applies when you move overseas income or gains into the UK and, within 45 days, use the funds to acquire qualifying investments. Investments which qualify for BIR are typically unquoted UK trading companies.

When the qualifying investment is sold, your original remittance will become taxable in the usual way. However, you will have 45 days to mitigate the liability, which can be achieved either by making a further qualifying investment or returning the funds overseas. Any gain on the investment can remain onshore without penalty.

COMBINING BUSINESS INVESTMENT RELIEF WITH THE ENTERPRISE INVESTMENT SCHEME

Claiming BIR on an investment does not affect your entitlement to other UK tax reliefs. As such, it is possible to combine BIR with the tax reliefs available through the Enterprise Investment Scheme (EIS), which include Income Tax relief equal to 30% of the amount invested.
